Customer Terms

These Customer Terms govern access to and use of Customer Portal Toolkit for JSM unless a separate written agreement with Mederak Apps applies.

1. Provider and acceptance

The App is provided by Piotr Mederak, ul. Magnolii 1K/2, 05-500 Nowa Wola, Poland, trading as Mederak Apps (“Mederak Apps”, “we”, “us”). “Customer” means the organization or person that acquires, installs or uses the App. By installing, accessing or using the App, the Customer accepts these Terms and confirms that the person acting for it has authority to do so.

2. Atlassian Marketplace and precedence

If the App is acquired through Atlassian Marketplace, Atlassian's Marketplace terms govern the Marketplace transaction, billing, licensing and platform access. These Terms govern the App service supplied by Mederak Apps. A signed order or separate written agreement prevails over these Terms to the extent of an express conflict. Atlassian is not a party to these Terms.

3. Service description and dependencies

Customer Portal Toolkit is a Jira Service Management Cloud app that lets authorized administrators configure customer-facing request context, privacy-treated service aggregates, compact charts and permission-checked actions on supported portal surfaces. The App depends on Jira/JSM plans, projects, fields, workflows, permissions, APIs and Atlassian Forge services. Jira Server, Jira Data Center and unsupported portal surfaces are outside the service.

4. License and subscription

Subject to these Terms, a valid installation and payment where applicable, Mederak Apps grants the Customer a limited, non-exclusive, non-transferable, non-sublicensable right to use the App for the Customer's internal business purposes on the licensed Jira Cloud site during the subscription or evaluation period. Marketplace pricing, user tier, trial, renewal, cancellation, tax and refund handling follow the applicable Marketplace order and Atlassian terms.

The Customer must not: use the App unlawfully or to harm another person; bypass access, licensing, privacy, rate, cost or safety controls; introduce malware; probe or test another tenant; extract credentials or data without authority; overload or disrupt the App or Atlassian services; resell or make the App available as a standalone service; or reverse engineer the App except to the extent a non-waivable law permits it.

7. Customer data, privacy and confidentiality

The Customer retains its rights in customer data. The Customer instructs Mederak Apps to process that data only as necessary to provide, secure and support the App and as otherwise documented in the Privacy Policy and Data Processing Summary. Mederak Apps will not sell customer data or use it for independent advertising. Each party will protect non-public information received from the other with reasonable care and use it only for the relationship, subject to lawful disclosure obligations.

8. Security

Mederak Apps will maintain reasonable technical and organizational safeguards appropriate to the App's architecture and data. The current practices are described in Security Practices. No system is completely secure. The Customer must cooperate with reasonable investigation and mitigation requests. Vulnerabilities must be reported through the process in Security Incident Response.

9. Optional AI

Forge LLM is optional Preview functionality, disabled by default and not required for core App behavior. AI may be unavailable, rate-limited, changed or withdrawn by Atlassian. Output can be inaccurate, incomplete or unsuitable and must be reviewed by a person. The Customer must not use AI output as authoritative Jira state or as the sole basis for legal, HR, security, financial, medical, safety or other high-impact decisions. 10. Aggregates, actions and generated output

Metrics, trends, percentiles, durations, confidence indicators and other generated output are informational estimates based on available and permitted Jira data. They are not contractual SLA results, audit evidence or professional advice. Permission-checked actions use current Jira/JSM state, but the Customer remains responsible for workflow design, authorization and the business consequences of actions.

11. Support, maintenance and changes

Support is provided under the published Support Policy. Mederak Apps may update the App to fix defects, improve security, maintain compatibility or change features. We will use reasonable efforts to communicate material deprecation or end-of-life changes through Marketplace, product or support channels. Preview capabilities may change with less notice due to Atlassian platform changes.

12. Availability

We aim to provide a reliable App but do not guarantee uninterrupted or error-free availability. The App depends on Atlassian Marketplace, Jira Cloud, Jira Service Management, Forge APIs and customer configuration, all of which are outside Mederak Apps' full control. Planned maintenance, emergency security work, third-party incidents and force majeure may affect service.

13. Intellectual property and feedback

Mederak Apps and its licensors retain all rights in the App, software, design, documentation and Mederak Apps marks. Atlassian retains its platform and marks. The Customer grants Mederak Apps permission to use feedback without restriction or payment, provided it does not identify the Customer or disclose confidential information.

14. Warranties and statutory rights

Mederak Apps warrants that it will provide the App with reasonable skill and care. Except for this express warranty and rights that cannot lawfully be excluded, the App is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation to the maximum extent permitted by law. Nothing in these Terms limits mandatory consumer or statutory rights.

15. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive or consequential loss, or loss of profit, revenue, goodwill, anticipated savings or business opportunity. Mederak Apps' total aggregate liability arising from the App during any 12-month period is limited to the fees paid or payable for the App during that period. If the App was provided without charge, the aggregate limit is EUR 100.

The limitations do not apply to liability that cannot legally be limited, including fraud, wilful misconduct, death or personal injury caused by negligence where applicable. They also do not limit the Customer's payment obligations or liability for unlawful use, infringement or deliberate circumvention of security controls.

16. Suspension and termination

The Customer may stop using or uninstall the App at any time, subject to Marketplace subscription terms. Mederak Apps may suspend or terminate access for material breach, non-payment, security risk, unlawful use, Atlassian requirement or discontinuation of the service, using reasonable notice where practicable. On termination, the license ends. Data handling follows Privacy and Uninstall and Data Deletion. Clauses that by their nature should survive termination remain effective.

17. General

The Customer may not assign these Terms without written consent, except in a merger or sale of substantially all relevant business assets. Mederak Apps may use subprocessors described on the Subprocessors page. Neither party is responsible for delay caused by events beyond reasonable control. If a provision is unenforceable, it will be adjusted to the minimum extent necessary and the rest remains effective. Failure to enforce a provision is not a waiver. These Terms and incorporated documents are the entire agreement for the App unless a signed agreement states otherwise.

18. Governing law and disputes

These Terms are governed by the laws of Poland, excluding conflict-of-law rules. Courts competent for the provider's registered location have jurisdiction, unless mandatory law requires another forum. Before filing a claim, the parties will try in good faith for 30 days to resolve the dispute through the support contact. Mandatory consumer rights and forums remain unaffected.

19. Changes and contact

We may update these Terms for legal, security, platform or product changes. Material changes will be communicated through an appropriate Marketplace, product or support channel and will apply prospectively from the stated effective date.
